The road to SB 68 started years ago, when calorie labeling became a federal requirement for restaurant chains with 20 or more locations. While this was a win for consumer awareness, allergen information remained notably absent. The 2022 FDA Food Code nudged things forward, requiring restaurants to acknowledge which allergens were present in their kitchens. But it didn’t go far enough because it didn’t specify allergens at the menu-item level, and it wasn’t universally adopted. 

Now, SB 68 bridges that gap. Signed into law on October 13, 2025, and effective July 1, 2026, the bill amends California’s Health and Safety Code to require restaurants and food facilities with 20 or more locations nationwide to clearly disclose if any of the nine major allergens (eggs, fish, milk, peanuts, sesame, shellfish, soy, tree nuts, or wheat) are ingredients in each menu item. These disclosures must appear directly on menus or menu boards or be easily accessible through a printed allergen chart or QR code. It’s a monumental step toward informed dining and a clear signal that allergen transparency is no longer optional, it’s expected.
